Terms and Conditions

These Terms and Conditions (“Terms”) are an agreement between you and GetVisibility (“GetVisibility”, “we”, “us” or “our”). They apply when you visit our website, create an account or purchase our website design and hosting service. By creating an account or making a payment you agree to these Terms. If you are signing up on behalf of a business, you confirm that you have authority to bind that business.

1. The service

GetVisibility designs, writes, builds and hosts a website for your business and provides a client dashboard with a built-in CRM for managing leads. The service includes design and copywriting, launch on your domain, hosting, security, ongoing edits and support, as described on our pricing page at the time you sign up.

2. Fees and billing

• Setup fee. A one-time setup fee of $79 is charged when you create your account. It covers design, copywriting and launch.
• Monthly plan. The plan costs $59 per month, charged in advance. The first month is charged together with the setup fee, and renewals are charged automatically on the same day each month until you cancel.
• Payments are processed by Razorpay. By paying you authorise us and Razorpay to charge your chosen payment method for these amounts.
• Price changes. We may change the monthly price with at least 30 days’ notice by email. The new price applies from your next renewal after the notice period.
• Failed payments. If a renewal fails we will retry and notify you. If payment is not received within 14 days we may suspend your website and dashboard until it is.
• Taxes. Prices exclude any applicable taxes unless stated otherwise.

3. Delivery and revisions

We aim to have a preview of your website ready within 24 hours of receiving your details and payment, and to launch it within 24 hours of your approval. Timelines depend on you providing the information we ask for and responding to previews. Delays caused by missing content, slow approvals or domain access issues are not our responsibility, but we will keep working with you until the site is live.

Reasonable revisions are included before launch and as part of your monthly plan afterwards. Requests that amount to a full redesign, a significantly larger site or custom development outside the plan may be quoted separately.

4. Your responsibilities

• Provide accurate information about yourself and your business and keep it up to date.
• Only send us content you have the right to use, including text, logos, photos, reviews and trademarks.
• Make sure your website and its contents comply with the laws and advertising rules that apply to your business, including any professional, healthcare or financial regulations.
• Keep your password confidential. You are responsible for activity under your account.
• Do not use the service for anything unlawful, misleading, harmful, infringing or abusive, or to send spam.

5. Ownership

Your content and domain are yours. You keep all rights to the content you provide. Your domain is registered in your name, and the text and images created for your website belong to you once the setup fee has been paid.

Our platform is ours. The underlying software, templates, design system, dashboard and CRM remain the property of GetVisibility and its licensors. We grant you a licence to use them as part of the service for as long as your plan is active. Stock images and fonts are licensed for use on your site and may not be reused elsewhere.

You give us permission to show your website in our portfolio and marketing. Tell us at any time if you would rather we did not.

6. Cancellation and refunds

• There is no long-term contract. You can cancel your monthly plan at any time from your dashboard or by emailing us. Your site stays live until the end of the period you have paid for, after which hosting and the dashboard are switched off.
• Monthly fees already paid are not refunded, except where required by law.
• The setup fee is refundable in full if you cancel before we have started work on your website. Once design has begun it is non-refundable, because the work has been done.
• If you cancel, we will provide a copy of your website content on request within 30 days, and will help you point your domain elsewhere.

7. Suspension and termination

We may suspend or end the service if you breach these Terms, if your use creates legal or security risk for us or others, or if payment is overdue. Where practical we will warn you first and give you a chance to fix the problem.

8. Availability and support

We work to keep your website online at all times, but we cannot promise uninterrupted availability. Maintenance, third-party outages and events beyond our control may cause downtime. Support is available by email and through your dashboard during business hours.

9. Search rankings and results

We build every site with search-engine and AI-search best practices, but we do not guarantee any particular ranking, traffic level, number of leads or business outcome. Those depend on many factors outside our control.

10. Disclaimer and limitation of liability

The service is provided “as is”. To the fullest extent permitted by law, we exclude all warranties not expressly stated in these Terms. We are not liable for indirect, incidental or consequential losses, including lost profits or lost business. Our total liability to you for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You agree to cover us against claims, losses and costs arising from content you provide, your use of the service in breach of these Terms, or your website’s breach of any law or third-party right.

12. Privacy

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and update the date at the top. For significant changes we will email account holders at least 14 days in advance. Continuing to use the service after the changes take effect means you accept them.

14. General

These Terms are the whole agreement between you and us about the service. If any part is found unenforceable, the rest still applies. We may assign these Terms as part of a sale or reorganisation of our business. These Terms are governed by the laws of the jurisdiction in which GetVisibility is established, and any dispute will be dealt with by the courts there, unless the law where you live gives you additional protections.
